Are Motorized Bicycles Legal in West Virginia

“wheelchair” means a motorized or non-motorized cycling device designed for a person with a disability who is unable to reach a speed greater than eight miles per hour and that is used by the person. In West Virginia, motorized bicycles and mopeds are defined as motorized bicycles, which: West Virginia currently has no laws regarding electric scooters. However, the state has taken care of the use of electric bicycles on public roads. In 2020, the state passed a law regulating electric bikes where they can be used and who can use them. A city in West Virginia is considering banning motorized bicycles. At the federal level, electric bikes are defined as bicycles with an electric motor that delivers 750 watts or less and has a maximum speed of 20 MPH on a flat surface. West Virginia is also a bit weird about e-bikes. Electric bikes are considered mopeds, and as such, one might think they need licenses and registration, but West Virginia completely ignores electric bikes and, as such, they are technically illegal to ride. Because e-bikes are usually ignored by lawmakers, they are usually treated like traditional bikes to determine where and how they can be ridden. That hasn`t stopped people from riding them, and it`s not very common for cyclists to be nailed to ride (you can surely buy electric bikes in West Virginia). Electric mountain bikes, for example, are certainly discussed with access to hiking trails, which varies from park to park, although overall any natural surface open to motorized and non-motorized use is a free game. “moped” means any motorcycle or motorcycle, unless otherwise specified in this Chapter, equipped with two or three wheels, pedals for muscle propulsion and an independent power source providing a maximum of two brakes, but not electric bicycles within the meaning of Article 17C-1-70 of this Code. When an internal combustion engine is used, the maximum displacement of the piston or rotor must be 50 cubic centimeters, regardless of the number of chambers in the power source.

The power source shall be capable of driving the vehicle unassisted at a speed not exceeding 30 miles per hour on a flat road and shall be equipped with a propulsion system which operates only directly or automatically and which does not require a clutch or gear change by the operator after the propulsion system has been switched on. The state of West Virginia has no laws designed specifically for motorized bicycles. Therefore, to be sure, we recommend that you follow the laws for mopeds, as they are the closest relatives of motorized bicycles. In recent years, mopeds — also known as motorized bicycles — have become increasingly popular in West Virginia and throughout the country. They are much cheaper to buy than a car or truck, are more fuel efficient and can be a lot of fun. The big disadvantage of this type of motor vehicle, of course, is that they offer much less protection than their larger counterpoints, making them more dangerous for drivers. Unfortunately, West Virginia does not currently recognize Class 2 electric bikes as bicycles. “passenger carrier” means any van or other motor vehicle owned by an agency, business or other legal person operated for the purpose of transporting children under the age of eighteen, other than a van used for private purposes, a taxi, a bus or a school bus.

Passenger carriers include, but are not limited to, vehicles used by day care centres, after-school care centres and kindergartens: provided that the term “passenger carrier” does not include a van or other motor vehicle used for the specific purpose of transporting children to medical facilities for medical or dental treatment and which loads and unloads children on private property, No stops for loading or unloading on public roads or highways. While you may be eager to get on your moped or scooter and see the road from a new perspective, you must first understand West Virginia law and follow all precautions and safety requirements before attempting to drive a moped or other motorized vehicle on a public road. Unfortunately, no amount of preparation can prevent accidents from happening completely. If you have been injured in an accident, our law firm can help. `owner` means a person who holds legal title to a vehicle or, in the event that a vehicle is the subject of an agreement on the conditional sale or lease of that vehicle, having the right to purchase from compliance with the conditions set out in the contract and an immediate right of ownership of the seller or conditional lessee; or, where a hypothecary debtor is entitled to own a vehicle, that conditional widow or lessee or hypothecary debtor shall be deemed to be the owner of the vehicle within the meaning of this Chapter. “motor vehicle” means any motor vehicle and any vehicle powered by electrical energy from overhead contact lines but not operated on rails, with the exception of motorized wheelchairs. Calvin Kirby, 34, has been using motorized bikes for two years. If you were injured in a moped accident, you may be entitled to compensation if someone else caused the accident. An experienced personal injury lawyer can analyze the facts of the case and provide legal advice on whether you have a legal claim. A lawsuit can help you get compensation for your damages, including lost wages, property damage, and medical bills. In these situations, the legal advice of an experienced personal injury attorney in West Virginia can be crucial.

Your lawyer can use their knowledge of the law to argue that it was speeding the other vehicle that caused the car accident, not your brief moment standing. Since West Virginia is a comparable negligent state, you can still recover as long as you are 50% or less responsible for the accident. West Virginia classifies electric bikes into two classes, Class 1 and Class 3. The state does not recognize Class 2 electric bikes as bicycles. Classes 1 and 3 describe the following: “Every motor vehicle must follow the motorized laws of the State of West Virginia and the City of Parkersburg, it really comes down to a safety issue,” Councillor Reed said. We suddenly had a big influx of people who decided to put engines on their bikes, and with that influx, there was a very rapid increase in the number of complaints that council members and the police department received,” said John Reed, President of Parkersburg City Council. “controlled-access highway” means any highway, road or road in respect of which the owners or residents of adjacent land and other persons have no legal right of access to or from it, except in such places and in a manner that may be determined by the authority responsible for that highway, road or road. West Virginia cyclists have the same rights and responsibilities as motorists, with of course the usual exceptions for things that wouldn`t affect cyclists anyway. As in most other states, additional protective measures will be put in place to protect cyclists on the road as much as possible, as cars destroy bicycles in the event of a collision! “electric bicycle” means any two- or three-wheeled bicycle equipped with fully functional pedals and an electric motor with a power of less than 750 watts and that is a Class 1 electric bicycle or a Class 3 electric bicycle. Martin said bikes can travel as fast as 20 miles per hour.

But he said some have trouble stopping quickly because they are equipped with regular bike brakes instead of disc brakes.
